			<content:encoded><![CDATA[<p>I was neither prepared nor in a particularly good mood when I did this &#8220;webinar&#8221; for <a href="http://agora.io/etienne">Agora I/O</a>. It was eerie having a &#8220;conversation&#8221; in which I could neither see nor hear the other participants. It was just me and my own voice, with questions and comments occasionally popping up in text on another webpage. Because of that, I couldn&#8217;t read anyone&#8217;s body language and try to pre-emptively smooth things over and &#8220;people please&#8221;; I could only speak my mind. Which I did. Which, upon reviewing, was a pretty great thing. You may not like me, but I sure do!<br />

<p>About a year and a half ago I released my film <em><a href="http://sitasingstheblues.com/" target="_blank">Sita Sings the Blues</a></em> under a <a href="http://creativecommons.org/licenses/by-sa/3.0/" target="_blank">Creative Commons Attribution-ShareAlike</a> license. That license allows <a href="http://blog.ninapaley.com/2010/08/31/four-freedoms-of-free-culture/" target="_blank">truly free</a> distribution, including commercial use, as long as the free license remains in place.  But my experience is that most people see the words “Creative Commons” and simply assume the license is <a href="http://en.wikipedia.org/wiki/Non-commercial" target="_blank">Non-Commercial </a>&#8211; because the majority of Creative Commons licenses they&#8217;ve seen elsewhere have been Non-Commercial.</p>
<p>This is a real problem. Some artists have re-released <em><a href="http://sitasingstheblues.com/" target="_blank">Sita</a></em> remixes under <a href="http://creativecommons.org/licenses/by-nc/3.0/" target="_blank">Creative Commons Non-Commercial</a> licenses. Many bloggers and journalists assume the non-commercial restrictions, even when the license is correctly named:</p>
<blockquote><p><em>The film was made available under a Creative Commons Attribution-Share  Alike License, allowing third parties to share the creative content for  <strong>non-commercial</strong></em> <em>purposes freely as long as the author of the content is  attributed as the creator of the work</em>. &#8211;from <a href="http://www.hinduonnet.com/fline/fl2610/stories/20090522261009200.htm" target="_blank">Frontline, India&#8217;s National Magazine</a></p></blockquote>
<p>Initially I tried to explain what &#8220;ShareAlike&#8221; means to CC-NC remixers of &#8220;Sita&#8221;, and asked them to please switch to ShareAlike, per the terms of the ShareAlike license under which I released it. I felt like an ass; I don&#8217;t want to be a licensing cop. After a while, mis-identifications of the project&#8217;s license became so widespread I gave up trying to correct them. &#8220;Creative Commons&#8221; means &#8220;Non-Commercial&#8221; to most people. Fighting it is a sisyphean task.</p>
<p>So I&#8217;m stuck with a branding problem. As long as I use <em>any</em> Creative Commons license, most people will think it prohibits commercial use. Hardly anyone seems to register, let alone understand, CC-SA.  Worse, those who do notice the ShareAlike marker combine it with Non-Commercial restrictions on their re-releases, which compounds the confusion (CC-NC-SA is the worst license I can imagine).</p>
<p>ShareAlike is an imperfect solution to copyright restrictions, as it imposes one restriction of its own: a restriction against imposing any further restrictions. It&#8217;s an attempt to use copyright against itself. As long as we live in a  world wherein everything is copyrighted by default, I will use ShareAlike or some other Copyleft equivalent to attempt to maintain a &#8220;copyright-free zone&#8221; around my works. In a better world, there would be no automatic copyright and thus no need for me to use any license at all. Should that Utopia come about, I will remove all licenses from all my work. Meanwhile I attempt to limit other peoples&#8217; freedom to limit other peoples&#8217; freedom.</p>
<p>It would be nice if the Creative Commons organization did something to address this branding confusion. We suggested re-branding ShareAlike licenses as <a href="http://questioncopyright.org/cc-pro" target="_blank">CC-PRO</a>, but given that Creative Commons&#8217; largest constituency is users of Non-Commercial licenses, it seems unlikely (but not impossible!) that they would distinguish their true Copyleft license with a &#8220;pro&#8221; brand.</p>

<p>It would also be nice if everyone, including representatives of Creative Commons, referred to their licenses by their names, instead of just &#8220;Creative Commons.&#8221; &#8220;Thank you for using a Creative Commons license,&#8221; they tell me. You&#8217;re welcome; I would thank you for calling it a ShareAlike license. Almost every journalist refers to all 7 licenses as simply &#8220;Creative Commons licenses.&#8221; And so in the popular imagination, my ShareAlike license is no different from a Non-Commercial, No-Derivatives license.</p>
<p>This branding crisis came to a head recently when the Canadian Broadcasting Corporation <a href="http://arstechnica.com/media/news/2010/10/cbc-radio-fans-crabby-over-creative-commons-snub.ars" target="_blank">banned</a> all Creative Commons licensed music in its shows:</p>
<blockquote><p><em>The issue with our use of Creative Commons music is that a lot of our content is readily available on a multitude of platforms, some of which are deemed to be &#8216;commercial&#8217; in nature (e.g. streaming with pre-roll ads, or pay for download on iTunes) and currently the vast majority of the music available under a Creative Commons license prohibits commercial use.</em></p>
<p><em><br />
In order to ensure that we continue to be in line with current Canadian copyright laws, and given the lack of a wide range of music that has a Creative Commons license allowing for commercial use, we made a decision to use music from our production library in our podcasts as this music has the proper usage rights attached. </em><a href="http://arstechnica.com/media/news/2010/10/cbc-radio-fans-crabby-over-creative-commons-snub.ars" target="_blank">link<br />

<p>The Creative Commons organization <a href="http://creativecommons.org/weblog/entry/23766" target="_blank">wants</a> to get the CBC to separate out its different licenses.  They could help by calling their licenses by their different names. If the Creative Commons organization itself calls them all &#8220;Creative Commons Licenses,&#8221; how can they expect others to distinguish the licenses from each other?</p>
<p>Perhaps Creative Commons should <em>only</em> offer the Non-Commercial/No Derivatives licenses everyone associates with the name. Then they could create a new name/brand for their Free licenses. FreeCommons? CultureSource? CopyLove?</p>
<p>Meanwhile, I&#8217;m wondering how to clearly communicate my work is COPYLEFT. In addition to the CC-SA license, if there&#8217;s room I write &#8220;COPYLEFT, ALL WRONGS REVERSED&#8221;. Unfortunately, the term &#8220;Copyleft&#8221; is growing increasingly meaningless as well. For example, Brett Gaylor&#8217;s mostly excellent film <a href="http://www.opensourcecinema.org/book/rip-remix-manifesto-chapter-2" target="_blank">RIP: A Remix Manifesto</a> gets a lot of things right, but it <a href="http://www.opensourcecinema.org/book/rip-remix-manifesto-chapter-2" target="_blank">misunderstands and misuses the term &#8220;copyleft&#8221;</a>. Copyleft <a href="http://en.wikipedia.org/wiki/Copyleft" target="_blank">actually means this</a>:</p>
<blockquote><p>the right to distribute copies and modified versions of a work and  requiring that the same rights be preserved in modified versions of the  work. In other words, copyleft is a general method for making a program  (or other work) free, and requiring all modified and extended versions  of the program to be free as well. <a href="http://en.wikipedia.org/wiki/Copyleft" target="_blank">-Wikipedia</a></p></blockquote>
<p>But in RIP it means this:</p>

<p>See that dollar sign with the slash in it? That means <a href="http://creativecommons.org/licenses/by-nc/3.0/" target="_blank">Non-Commercial</a> restrictions, which are most definitely NOT Copyleft.</p>

<p>Anyone introduced to the word &#8220;Copyleft&#8221; in that film won&#8217;t know what Copyleft actually means in terms of licenses.</p>
<p>I need a license that people understand. I&#8217;m tempted by the <a href="http://sam.zoy.org/wtfpl/" target="_blank">WTFPL</a> but I would have to fork it to add a copyleft provision. The Do Whatever You Want And Don&#8217;t Restrict Others From Doing Whatever They Want Public License? WTFDROPL?</p>
<p>Are there any other useable Copyleft licenses out there that aren&#8217;t associated with non-commercial restrictions? I&#8217;m open to suggestions.</p>

<p>People seem to want to believe that just freeing works is some magic recipe for success. It isn&#8217;t. But since people crave simple business models, I came up with one this morning:</p>
<p>Quality<br />
Freedom<br />
Money<br />
______<br />
Any Two = success</p>
<p>A very good (Quality) film can succeed if it is Free (Freedom) OR has a big promotional budget (Money). A Free film can succeed if it is very good (Quality) or, if it&#8217;s not so good, it has lots of paid promotion (Money, because if it&#8217;s not good people won&#8217;t promote it on their own initiative). A film with lots of Money will succeed if it&#8217;s good (Quality) or if it&#8217;s Free. Imagine how much further a crap film could go if it&#8217;s not only heavily advertised, but Free to share too.</p>
<p>With only one of these properties, a film is unlikely to succeed. If a film is very good but neither Free nor Moneyed, no one will hear about it and it won&#8217;t have a chance to become popular. A Free film that sucks won&#8217;t go far. A Moneyed film will garner attention only as long as it&#8217;s being promoted; once ad spending stops, audience attention goes away.</p>
<p>With all three of these elements, you&#8217;ll have a success the likes of which the world has never seen. Moneyed productions have yet to be Free, but maybe someday, for some reason, someone will pour tons of cash into promoting a Free, Quality production. Of course if it fails, that will be due to insufficient Quality, which can&#8217;t really be measured and for which no one wants to take responsibility. If someone wants to try this experiment with <a href="http://www.sitasingstheblues.com"><em>Sita Sings the Blues</em></a>, which is already considered &#8220;good&#8221; and is forever &#8220;free,&#8221; be my guest!</p>
<p>Given the financial dire straits of the independent film industry, filmmakers should really be looking at Free, because they&#8217;re unlikely to have Money. And everyone, always, should be focused on Quality, no matter what business model they prefer. Except Quality is a mystery, and worrying about it does not lead to better Art. But if you happen to luck into some Quality, you know what to do now.</p>

			<content:encoded><![CDATA[<p>I&#8217;m working on a new project &#8211; a book, or comic book, or illustrated book, or graphic <em>something</em> about free culture/free content. I&#8217;ll probably use a mix of styles and techniques, since that&#8217;s how I roll. But I&#8217;m trying to figure out the dominant one.  And the question is: hand drawing with ink on paper, or drawing directly into the &#8216;pooter using a vector drawing program (Flash)? Behold two approaches saying basically the same thing:</p>

<p>The image above was &#8220;drawn&#8221; with the Cintiq, directly into Flash. I like it because it keeps the focus on the idea and not on the humans.</p>

<p>Same idea, different technique. It&#8217;s much &#8220;warmer&#8221; and friendlier. But it draws you into the humans, more than the meme they&#8217;re sharing. Drawing humans like this, they each need genders, clothes, and other identifiers which are mostly irrelevant to the point I&#8217;m trying to make. On the other hand, warmer drawings may attract more viewers, which is desirable, and may be sufficient for the idea anyway.</p>
<p>What do you think?</p>
<p>Update: per Richard O&#8217;Connor&#8217;s suggestion, a hybrid:</p>

<p>The problem with this is that the meme looks sterile, while the people look warm and alive. I&#8217;m trying to express that it&#8217;s the <em>memes</em> that are alive; that we humans are just their humble servants.</p>

			<content:encoded><![CDATA[<p>Sometimes I&#8217;m asked if I have any &#8220;advice&#8221; for the young&#8217;uns. I seem to give a different answer every time. Today&#8217;s answer is:</p>
<blockquote><p>ADVICE:</p>
<p>Stop taking advice and stop asking for it.</p>
<p>The world is unlimited! There are a zillion ways to do things. Don&#8217;t be afraid of doing things wrong. The only way we make progress is from trying things, and that means a lot of failure. I&#8217;ve been helped by other peoples&#8217; failures &#8211; they show me what not to do, so I can learn from their mistakes &#8211; and I hope my failures help other people succeed too. So even failure is a social contribution, as long as you&#8217;re failing YOUR way. An authentic failure is worth 100 insincere successes.</p>
<p>Do it YOUR way, not my way.</p>
<p>Looking to others to tell you what to do and how to do it is a bad habit. You can learn a lot just by observing. Let your observations be your teachers. What people SAY is not the same as what they DO, so pay attention to what they DO and learn from that.</p>
<p>If there&#8217;s something you can&#8217;t learn from observing, do some research. If research still doesn&#8217;t answer your question, THEN ask for advice. If you go straight to asking for advice, and expecting your answers there, you will miss out on all kinds of observations and learning.</p>
<p>That is my advice.</p></blockquote>
